Terms of Service

Welcome to AdvanceQuiz Organization ("AdvanceQuiz", "we", "us", "our", or "Development Team"). By accessing, subscribing to, downloading, or utilizing any software, cloud application, service, mobile application, custom platform, or backend ecosystem developed or operated by AdvanceQuiz Organization—including enterprise SaaS modules, organization custom software solutions (covering modules such as Accounts, Admin, Book Store, Coupons, Courses, Nitya Seva, Dashboards, Todo, and any custom software application built for any entity), and public software platforms—you ("User", "Licensee", or "Client") agree to be fully bound by these Terms of Service and our associated Privacy Policy.

Any individual, organization, institution, or entity utilizing any software created by AdvanceQuiz Organization automatically agrees to and is governed by these exact Terms and Conditions and Privacy Policy. If you do not agree to all provisions contained herein, you must immediately cease using all our applications and services.

Software services developed and distributed by AdvanceQuiz Organization are granted under specific licensing structures as designated within individual software tiers or customized enterprise agreements:

• Lifetime License: Grants a non-exclusive, non-transferable, perpetual right to access and utilize the specific software version and features as specified in your purchase agreement without recurring core software licensing fees, subject to strict compliance with these Terms.
• Monthly Subscription: Grants non-exclusive access to the software functionality on a recurring billing cycle, remaining active solely while applicable subscription fees are continuously maintained.

Every software product provided by AdvanceQuiz Organization explicitly details its applicable licensing model within its designated interface or contract. Access rights remain contingent upon full adherence to user obligations specified herein.

Strict Anti-Copy & IP Ownership Policy: All software architecture, system logic, algorithmic designs, database structures, user interfaces, documentation, and digital assets associated with AdvanceQuiz Organization applications are the exclusive, protected intellectual property of AdvanceQuiz Organization and its Development Team.

• Prohibition of Code Extraction & Duplication: Users, clients, developers, and third parties are strictly prohibited from copying, extracting, duplicating, reverse engineering, decompiling, disassembling, modifying, or creating derivative works from any part of the software logic, architecture, or codebase.
• Enforcement & Legal Compliance: Any unauthorized copying, redistribution, or extraction of software code or proprietary assets constitutes a direct violation of international intellectual property conventions and statutory laws (including the Indian Copyright Act, 1957). Such actions will result in immediate termination of software access and full civil and criminal legal proceedings.

SaaS Delivery & Executable Code Provision: Software developed by AdvanceQuiz Organization is delivered primarily as an enterprise Software-as-a-Service (SaaS) cloud platform, or, solely at the discretion and election of AdvanceQuiz Organization, as a pre-compiled standalone executable application code package (compiled into high-performance machine code or bytecode for dedicated server deployment). AdvanceQuiz Organization retains the sole and exclusive authority to determine whether executable application code is provided or shared with the Client.

Executable Code Lifetime License & Third-Party Developer Restrictions: Where AdvanceQuiz Organization elects to deliver executable application code to the Client:

• Internal Operational Use Only: The Client is granted a dedicated, non-exclusive, non-transferable, and non-sublicensable Lifetime License strictly for internal operational execution within their own organization.
• Strict Prohibition on Sharing with Outside Developers: The Client is strictly and unconditionally prohibited from sharing, sending, leasing, selling, sublicensing, transferring, or exposing the executable code, in whole or in part, to any outside software developer, freelance programmer, third-party IT agency, contractor, competing vendor, or external entity under any circumstances or pretext.
• Exclusive Self-Operation: The executable application code is provided exclusively for the Client organization's direct operational usage. External developers or third parties are strictly barred from receiving, handling, or managing the executable code.

Immediate License Revocation & Permanent Termination of Support on Breach: If the Client violates this policy by transferring, sharing, or disclosing the executable code to any outside developer, agency, or unauthorized third party:

• Instant License Cancellation: The Client's Software Lifetime License will be immediately, automatically, and permanently revoked, cancelled, and declared null and void without prior notice or refund.
• Permanent Forfeiture of Support & Maintenance: AdvanceQuiz Organization and its Development Team permanently and entirely terminate all technical support, debugging, error resolution, bug fixes, updates, maintenance, and operational assistance for the Client. AdvanceQuiz Organization shall bear zero responsibility or liability, and will under no circumstances fix any issues, bugs, system failures, or downtime for the Client thereafter.

Raw Source Code Buyout Policy: Raw, uncompiled, editable source code is strictly excluded from all standard sales, deliveries, and software licenses. AdvanceQuiz Organization will not deliver or disclose raw source code under any standard agreement, even if requested or demanded by the Client. Raw source code can ONLY be acquired if the Client enters into an explicit, separate Source Code Buyout Agreement and agrees to pay a substantial commercial multiple (several times the initial project development cost) as evaluated and established by AdvanceQuiz Organization. Without full advance payment of this dedicated buyout multiple, raw source code will never be delivered or disclosed under any condition.

AdvanceQuiz Organization incorporates industry-standard third-party diagnostic telemetry, performance analytics platforms (such as Google Analytics and Firebase Analytics), and artificial intelligence (AI) algorithms to optimize system efficiency, code stability, developmental diagnostics, and automated service workflows.

Limitation of Liability for Third-Party Operations: AdvanceQuiz Organization and its Development Team accept zero liability, responsibility, or financial obligation for data handling, telemetry collection, or algorithmic evaluations conducted independently by third-party analytics frameworks or external AI infrastructure providers. Third-party integrations operate under their respective independent operating guidelines and legal frameworks.

AdvanceQuiz Organization operates under strict enterprise non-disclosure standards and robust confidentiality protocols regarding authorized user data and proprietary records.

Governing Statutory Framework: These Terms shall be governed by, construed, and enforced in accordance with the applicable laws of India. This agreement incorporates principles of the Indian Contract Act (1872), Indian Non-Disclosure Agreement standards, and statutory data privacy principles. All disputes arising hereunder shall be subject to the exclusive jurisdiction of applicable courts in India.

Hosting & Infrastructure Cost Responsibility: A Lifetime License grants perpetual access rights to the core software application upon payment of a one-time software license fee. However, the Licensee, User, or Client independently assumes 100% full financial and operational responsibility for all ongoing cloud server hosting, database infrastructure, server maintenance, bandwidth, and domain renewals required to host and run their software instances.

AdvanceQuiz Organization and its Development Team do not provide free server hosting or infrastructure management under core software licensing fees. All recurring server hosting costs must be borne directly by the Client.

Dedicated/Separate Server Provision: By default, services are hosted on multi-tenant shared servers. If a Client requests deployment on a separate, dedicated server environment:

• The Client must pay a server migration setup charge and cover 100% of the monthly server hosting and infrastructure subscription fees.
• As long as the Client maintains active server hosting payments, the dedicated server will continue running. Non-payment of monthly server bills will result in immediate suspension or termination of the software instance.
• Even on a separate/dedicated server, the solution is delivered strictly as Software-as-a-Service (SaaS). The Client will not be granted access to the underlying server environment, database configurations, or command-line terminals, nor will any source code or database access be delivered.

Custom SaaS Upkeep & Mandatory Maintenance: Because each client instance is a customized Software-as-a-Service (SaaS) solution rather than a generic off-the-shelf product, ongoing technical maintenance, monitoring, troubleshooting, and operational upkeep are subject to a separate recurring Maintenance Fee or Annual Maintenance Contract (AMC).

If the Client declines or fails to pay the maintenance charges, AdvanceQuiz Organization and its Development Team assume zero responsibility or liability for any software malfunctions, bugs, performance issues, system downtime, or complete service interruptions. System restoration and error resolutions will not be performed under any circumstances without an active maintenance plan.

Custom Enhancements & Premium Security Integrations: Core software packages include base feature sets. Any request for additional custom features, specialized integrations, or advanced enterprise security implementations—including but not limited to Google OAuth Login, Passkeys biometric authentication, Two-Factor Authentication (2FA), or advanced security protocols—will incur separate, distinct service charges under independent developmental billing agreements.

Billing Enforcement: The software is provided strictly on a Software-as-a-Service (SaaS) basis or agreed license model. If the User or Client fails to pay the required fees, makes only a partial payment, or has outstanding dues, we reserve the right to display reminder notifications (such as pop-ups or alerts within the software interface) or suspend/shut down the software instance. If zero payment is received, the software instance will be temporarily disabled. Upon receipt of all outstanding dues along with an applicable late payment fee, the software instance will be re-enabled.

Binding to Authorized Portals Only: All API keys, WebSocket connections, backend tokens, and any other credentials or access mechanisms issued or integrated by AdvanceQuiz Organization are strictly bound to the specific authorized portal, domain, or application for which they were originally configured and deployed. These credentials may not be reused, transferred, or embedded in any other platform, website, application, or system.

AdvanceQuiz Organization Directives Govern All API Access: Whether the designated portal or website is a private internal portal, a public-facing website, or any other type of platform — the decision of where, how, and to which portals or websites our API keys, backend endpoints, WebSocket connections, or any other backend credentials are granted access is determined exclusively by AdvanceQuiz Organization's written directives and instructions. Clients, users, or licensees hold no independent authority to define, extend, or modify the scope of API access on their own.

• No Third-Party Platform Usage: If a Client or Licensee migrates to, builds, or operates a separate website, portal, or frontend application not built or managed by AdvanceQuiz Organization, they are strictly prohibited from reusing or embedding the same API keys, backend endpoints, WebSocket connections, or service credentials in that separate platform. Such use constitutes unauthorized access and a material breach of this agreement.
• No Split Frontend/Backend Deployment: Clients may not separate the frontend interface from the backend services or APIs and host them independently. Connecting any independently built or third-party frontend to our backend infrastructure, APIs, or WebSocket endpoints without written authorization from AdvanceQuiz Organization is strictly prohibited.
• Security Risk & Revocation: Unauthorized use of API keys or backend credentials in unmanaged environments poses serious security risks. AdvanceQuiz Organization reserves the right to immediately revoke or invalidate any API key, token, or access credential if unauthorized usage is detected, without prior notice and without liability.
• Enforcement: Any violation of this clause will result in immediate suspension of all services, revocation of the software license, and may trigger legal action for breach of contract and unauthorized access under applicable laws.

If a Client wishes to migrate to a new portal or platform, they must engage AdvanceQuiz Organization directly to initiate a new authorized deployment under a fresh agreement.
